DescriptionReasons for Decision
NoteAfter consideration of the development against section 4.15 of the Environmental Planning and Assessment Act 1979 and the relevant statutory and policy provisions, the proposal is not suitable for the site and is contrary to the public interest. Therefore, it is recommended that the application be refused for the following reasons: · The proposal is non-compliant with Clause 4.1B(2)(b) of RLEP2014 and the submitted Clause 4.6 requesting to vary the development standard is considered to be inadequate and unsatisfactory; · The reduced property width will result in an undesired precedence within Richmond Street and undermines the integrity of the standard; · Given that the proposal does not meet Clause 4.1B(2)(b) of RLEP2014; · The proposal does not comply with the FSR development standard of Clause 4.4 and no Clause 4.6 variation has been sought. Council cannot approve the development in the absence of a variation being sought; · The development will be inconsistent with the desired future character of the area streetscape. The proposal width does not enable the required landscaping setting within the front setback with excessive hard paving which exacerbates the inconsistency with the established built form character within Richmond Street; · Limited information has been supplied for the proposed surface levels for the detention basin, top of wall heights, excavation within the rear setback and methods for surface drainage within the rear setback; · The development does not relate to the existing topography of the land; · The development is considered to be not suitable for the site; and · The proposal is considered to be contrary to the public interest.
