Note1. The proposal is not in accordance with the aims of the State Environmental Planning Policy (Affordable Rental Housing) 2009 in that the proposal has allocated a portion of the bonus floor space allowed under Clause 29 (c)(ii) for use other than for affordable rental housing. A portion of the bonus floor space has been allocated to the residential and retail component of the development which is contrary to the aims of the ARH SEPP. 2. The proposal has a maximum building height of 25.8m (Building A), 26.4m (Building B), 24.5 (Building C) and 25.8m (Building D), and exceeds the building height development standard of 21.5m and 18.5m under Clause 4.3 of the Ryde Local Environmental Plan 2014. The applicant has failed to provide an adequate Clause 4.6 written justification demonstrating that compliance with the development standard is unreasonable and unnecessary, and that the variation will not result in any adverse environmental impacts on surrounding properties. The proposed exceedance in building height and as a result of the additional floor space presents excessive building bulk and scale and is inconsistent with the desired future character of the local area and will detract from the streetscape. 3. A bonus 448.7m2 of floor space, of which has been added in accordance with the ARH SEPP, has been incorrectly allocated to the non affordable housing component of the development. The bonus floor space can only be added for the purpose of affordable housing, and as such, the proposal will exceed the maximum floor space allowed under Clause 4.4 of Ryde Local Environmental Plan 2014 by 7.3%. No written request pursuant to Clause 4.6 has been submitted to justify the variation. 4. The proposed development has not satisfactorily demonstrated that the traffic generated by the proposed development will not have any adverse impact on the surrounding street networks. 5. The proposed development fails to comply with a number of design criteria and objectives under the Apartment Design Guide for the residential apartments and Council’s DCP - Boarding House for the boarding house. 6. The proposed development will result in poor amenity for future occupants due to the design of the development. 7. The proposed development has not provided sufficient information to enable full assessment of the public domain requirements, stormwater and landscaping maintenance and requirements.
